Clearance Items Terms of Sale

1. Application of These Terms

1.1 These Clearance Terms apply to all Clearance Products sold by Salacia including items sold:

  • Via the Salacia Clearance shop powered by Shopify;
  • Via eBay;
  • By telephone;
  • At showroom clearance events;
  • Through in-person collection.

1.2 These Terms form part of and must be read in conjunction with:

  • The Salacia Terms & Conditions of Sale;
  • The Shipping & Delivery Policy;
  • Any platform-specific policies (including eBay return rules where applicable).

1.3 In the event of any conflict:

  • Statutory consumer rights prevail;
  • Platform rules (e.g. eBay) prevail where required;
  • Otherwise, these Clearance Terms apply in addition to the main Terms of Sale.
     

2. Nature of Clearance Goods

2.1 Clearance Products may include:

  • Ex-display items;
  • Surplus stock;
  • Discontinued lines;
  • End-of-range items;
  • Products with cosmetic marks;
  • Items supplied without original packaging.

2.2 Clearance Products are sold at a reduced price reflecting their condition and availability.

2.3 Clearance Products may not include full manufacturer warranty unless explicitly stated.
 

3. Condition & Product Description

3.1 All known defects, cosmetic marks or imperfections will be described in the listing and/or shown in images.

3.2 Customers are responsible for reviewing:

  • The full product description;
  • All photographs;
  • Any stated condition notes;
  • Delivery limitations.

3.3 Images and descriptions form part of the contract.

3.4 Minor signs of prior installation, handling or display may be present and are not grounds for return where disclosed.
 

4. Delivery & Postage

4.1 Clearance deliveries are subject to the Salacia Clearance Shipping & Delivery Policy.

4.2 Delivery areas may be restricted. The Company reserves the right to:

  • Refuse delivery to certain postcodes;
  • Apply additional delivery charges where required;
  • Require pallet or specialist delivery for larger items.

4.3 Delivery charges will be stated at checkout or confirmed prior to dispatch.

4.4 Where delivery is to a remote, offshore, or surcharge postcode, additional fees may apply and must be agreed before dispatch.

4.5 Collection from the showroom is available where stated.
 

5. Risk & Damage in Transit

5.1 Risk passes to the Customer upon delivery or collection.

5.2 Upon delivery, the Customer must:

  • Inspect the goods immediately;
  • Note any visible damage on the delivery note;
  • Report damage in writing within 24 hours to clearance@salacia.co.uk
  • Provide photographic evidence where requested.

5.3 Failure to report damage within 24 hours may invalidate claims against the courier.

5.4 Where damage is confirmed as having occurred during courier transit and is reported correctly:

  • The Company will arrange replacement where possible; or
  • Provide an appropriate refund where replacement is not available.

5.5 The Company is not liable for damage caused after delivery, including damage during handling, storage, or installation.
 

6. Showroom Clearance Purchases

6.1 Clearance goods purchased in person are sold as inspected.

6.2 No discretionary returns are permitted for showroom clearance purchases.

6.3 Customers are responsible for fully inspecting goods prior to purchase or collection.
 

7. Distance Clearance Purchases 

7.1 Where a Clearance Product is purchased at a distance by a consumer, statutory 14-day cancellation rights apply.

7.2 The Customer is responsible for return carriage costs unless the goods are faulty.

7.3 The Company may make a reasonable deduction for any loss in value resulting from handling beyond what is necessary to inspect the goods.

7.4 No goodwill returns are accepted after expiry of the 14-day statutory cancellation period.
 

8. Business Purchases

8.1 Where the Customer is purchasing in the course of business, statutory consumer cancellation rights do not apply.

8.2 Returns of Clearance goods purchased by Business Customers are not accepted unless the goods are faulty or not as described.
 

9. Installation & Suitability

9.1 The Company strongly recommends checking all dimensions and product suitability before installation.

9.2 No credit will be issued for goods damaged during installation or due to incorrect specification.
 

10. Platform Sales (eBay)

10.1 Where a Clearance item is purchased via eBay:

  • eBay’s return and dispute resolution policies apply;
  • These Clearance Terms apply insofar as they are consistent with eBay rules;
  • In the event of conflict, eBay’s policies prevail.
